Read moreIn the cross-jurisdictional case Beri v Sachdeva, 2026, our family law team successfully represented the Respondent at the Supreme Court of Canada. This case has spanned three international jurisdictions, raised highly contentious issues involving family violence, child protection and best interests of the child considerations.
McQuarrie’s family law team has successfully defended a mother’s right to remain in Canada with her children at the British Columbia Supreme Court, the British Columbia Court of Appeal and now the Supreme Court of Canada.
The Beri v Sachdeva litigation concerns a Hague Convention on the Civil Aspects of International Child Abduction, made application by a father seeking the return of his two children from British Columbia to California. The parents married in India in 2011 and have two children, who were born in India. The family moved to California in May 2021. On August 26, 2024 the mother fled to British Columbia with both children.
As result, custody and guardianship of the children will remain with the mother in British Columbia.
