Alternative Dispute Resolution

McQuarrie Hunter LLP recognizes that the conflicts that develop in family disputes can be emotionally taxing for all parties. It is our goal to minimize the stress and discomfort of our clients as they move toward resolution of the issues arising from the breakdown of a marriage or common-law relationship. Depending on the circumstances, court proceedings are not always the best way to get a fair and just result in a timely manner. Going to court is time consuming, expensive, stressful and, where children are involved, can create a combative atmosphere that is not beneficial for developing productive post-separation parenting relationships. Further, going to court means that the decisions that directly impact you and your children are removed from your immediate control.

About Alternative Dispute Resolution (ADR)

ADR is one option to side step court proceedings and reach a lasting resolution to family law disputes that accommodate the unique circumstances of your family members. ADR includes things like settlement negotiations and family law mediation.

Family Law Mediation

Family law mediation is a collaborative structure where the separating couple use the assistance of a neutral third party (a mediator) who is trained to deal with all the issues that can arise when couples decide to separate. We frequently represent clients who are working with a family law mediator and a team of support professionals including accountants, financial planners, counselors and parenting coaches to develop creative resolutions to family law disputes. We interpret the information provided by these professionals, and can explain to our clients the pros and cons of different options. We then review the resulting separation agreement and explain the long-term consequences of signing the document.

Alternative Dispute Resolution Experience

The family law lawyers at McQuarrie Hunter LLP have extensive experience reaching settlement through negotiation and mediation on matters including:

  • Division of assets for married, common law and same-sex couples
  • Child and spousal support
  • Child custody, guardianship, access and parenting plans
  • Mobility applications (the right to move where children are involved)

While we encourage our clients to explore options to settle family law matters outside the courts, if it is clear that alternatives dispute resolution is not producing fair results or is otherwise inappropriate, we provide experienced courtroom representation to protect the rights and long term interests of our clients.

Regardless of the form of dispute, our lawyers and their assistants always make it a priority to provide clients with high quality service at a reasonable price.
